Brenda Jones was caught drink-driving her mobility scooter
Brenda Jones who is 64 has said that she would be happy to take the rap for crashing her mobility scooter in to a parked car while she was double the drink-drive limit. Brenda is said to have hit a parked car when she lost control of her buggy after drinking brandy and cokes at home alone in the afternoon. The incident happened in Loose Road, Maidstone. Brenda was charged with driving a motor vehicle while over the alcohol limit.

On Wednesday at Maidstone Magistrates’ Court the judge said that the scooter does not meet the criteria for a “motor vehicle” so Brenda’s guilty plea was withdrawn by the court. Brenda on the other hand said that she deserves everything that she gets.

Brenda said that “I’d had a couple of drinks that afternoon and I just lost control. I never realised it would come to this. I hold my hands up and I’m happy to take the rap. I was drink-driving so I should be punished, but hopefully I’ll just get a fine and can put it all behind me.”

Apparently Prosecutors are now considering a criminal damage charge over the car she hit but this can not be done because the police failed to take a statement from the cars owner at the time of the incident.

A senior Crown Prosecution Service source said that “In 21 years of criminal law, I’ve never heard of a case like this coming to court before. The charge should never have been brought like this. It seems the police were over-zealous to bring a driving charge as soon as they smelt drink. We can’t proceed with the criminal damage charge instead yet because a witness statement has not been obtained from the owner of the damaged vehicle. It’s a total mess.”

Under the Road Traffic Act, a motor vehicle is defined as one which weighs at least 240kg. The scooter weighs just 100kg. Marian Boyd, who was prosecuting, said that “It seems to me that this invalid carriage should not form part of a charge under the act because it clearly does not qualify as a motor vehicle.”

It’s reported that Brenda is now remanded on unconditional bail until next month, and the court advised her to be represented by a solicitor.
